General Hires / Bookings
TERMS AND CONDITIONS
Application and payments
No booking will be confirmed until the Tuggeranong Arts Centre has received the signed Hire Agreement, any applicable security deposit and the Hirer’s Certificate of Currency for Public Risk. The late return of any of these documents or payments could result in the cancellation of the Hirer’s booking.
The Hirer has 14 days to return the Hire Agreement with payment, to the Tuggeranong Arts Centre.
Indemnity and Insurance
Tuggeranong Arts Centre (TAC) cannot be held liable for any damages incurred to the Hirer’s equipment or for any injury caused by a Hirer’s negligence. The Hirer must also indemnify the TAC and/or the CEO in relation to any liability or claim for damages arising out of the negligence or breach of contract by the Hirer. The Hirer must hold Public Risk Liability to the value of $20,000,000 (unless otherwise agreed by both parties). A copy of the current Certificate of Currency for Public Risk should be supplied to the TCA Management with the return of the signed Hire Agreement.
Cancellation
1. If the Hirer does not make the final payment by the agreed date Tuggeranong Arts Centre will deem that the Hirer has cancelled the booking. The Hirer will forfeit the deposit / monies paid.
2. If the CEO of Tuggeranong Arts Centre considers that the hired space is unfit for use, he/she may cancel the booking. A full refund will be paid to the Hirer in this case.
3. In the event of a hiring cancellation, the CEO of the Arts Centre must be notified in writing by the hirer with at least a fortnight notice. Failure to notify the CEO of the Arts Centre of the cancellation will result in the forfeiting of the deposit and any monies paid.
4. Up to two (2) dates per term may be rescheduled on negotiation with the CEO.
Security deposit
Security deposit charged to hirers, as applicable. The security deposit will be refunded provided that the space is left undamaged and clean at the end of the contract / Hire period. Additional costs will be sought if damages costs exceed the deposit paid.
Length of Hire
If the Hirer exceeds the contracted hire time, the Hirer will be charged for the additional time according to the relevant rate.
Settlement of Accounts
Any additional charges or monies refundable due after the Hirer has paid the initial deposit and/or hiring costs will be calculated within 7-14 days of the completion of the hire. TAC will supply the Hirer with a copy of the reconciliation. If a security deposit is held, charges will be deducted from it as applicable, and any balance remaining will be refunded to the hirer within 7 days, if further charges are incurred by Hirer then an invoice will be issued and payment will be required within 7 days.
Building Security
TAC is equipped with an electronic security system. The relevant keys, security code and the security briefing will be supplied to you on the nearest business day prior to your hire period, if applicable. If the hirer breaches the security of the building, resulting in security services being called, the cost will be borne by the Hirer.
Safety Briefing
TAC will provide a safety induction. This briefing will cover: familiarisation with the Art Centre’s equipment, safety procedures and requirements, access to facilities, etc. This briefing is compulsory and should take place before the commencement of the hiring agreement at a time convenient for TAC Management.
All Hirers will be expected to keep class / participant rolls for safety and security purposes including Emergency contact numbers, as appropriate.
The Hirer shall comply with any directions given by TAC or any other competent authority (including but not limited to emergency services officers, such as fire fighters, police officers and ambulance officers), in respect of the safe and efficient use of the Venue. The Hirer will be responsible for their participants in emergency situations.
IMPORTANT:
Hirers are reminded that TAC is a multi-purpose arts facility and that the hire of any space is the hire of a shared space. TAC operates 3 galleries, 2 dance studios, a theatre, a multi-purpose space and a workshop space in the same building. If activity or noise severely disrupts activities elsewhere in the building, the Hirer is expected to co-operate with TAC Management to resolve the problem.
Failure to cooperate in this manner may result in TAC’s refusal to make venues available to the hirer again in the future.
Venue management
The Hirer shall ensure that all current Health and Safety Legislation is adhered to, that all their personnel are properly trained in the use of any equipment that may be necessary and that all materials and equipment brought into the venue comply with TAC’s safety and risk management rules, including those relating to hazardous materials, flammable liquids, pyrotechnics, prop firearms or other weapons, lasers and strobe lighting, animals, electrical safety and manual handling.
The Hirer shall ensure that no smoke and haze generating activities are undertaken in the Venue at any time
The Hirer shall ensure all emergency exit doorways, passageways and loading docks are left clear at all times and exit signs left visible. The Hirer will not interfere in any way with the operation of the fire doors, smoke detectors or other safety equipment.
The Hirer shall inform TAC immediately on the Hirer becoming aware of any breakages or damage to the Venue or its fittings or fixtures and pay for any damage or loss suffered by TAC that is caused by the negligence of the Hirer.
The Hirer shall not make any alterations or additions to any part of the Venue, or attach in any way to walls, doors, glass, floors, furniture, or fittings in or around the Venue using nails, screws, adhesive tape or other items without the prior consent of TAC.
Technical Equipment
The Hirer shall ensure that all electrical equipment brought onsite is tested and tagged safe prior to arrival at TAC as per policy, workplace health and safety requirements and current Australian Standards (AS/NZS 3760). Any portable electrical equipment not displaying a current test tag may not be operated under any circumstances.
The Hirer shall not interfere with or alter any of the electrical installations, lighting, sound systems or other technical equipment owned TAC, or operate any equipment unless with express approval by TAC
The Hirer shall follow all directions given by TAC in respect of any property or equipment owned by TAC and shall operate any such equipment only with express approval by TAC. If the Hirer wishes to run TAC’s technical equipment, a meeting with a TAC technician must be arranged prior to the show. This technical assistance may incur additional costs. All other associated costs will also be borne by the Hirer.
Service Faults
If a failure or a fault occurs during the hire period in the mechanical systems, electricity supply, lift, lighting or public address system of the Arts Centre, TAC will not be liable for any loss or damage which may occur. Faults should be reported as soon as possible to the TAC Staff on duty.
Cleaning
The Hirer is required to leave the building, including toilets, showers and dressing rooms in the condition in which they were found. The Hirer is responsible for the removal of all perishable materials from the building to the receptacles provided. If, after the end of the hiring period, the condition of the hired space is such that TAC must arrange for extra cleaning, all extra cleaning charges will be passed on to the hirer as part of the final settlement.
Making Good Damages
The Hirer agrees to pay to TAC the cost of repairing or making good any damage to the TAC arising out of, or incidental to, the hiring, and for the loss of TAC equipment included in the hiring. The Hirer shall not be held responsible for any damage caused by an act of nature.
Noise Control
The TAC is subject to the Noise Control Act 1988. Any undue interference with the neighbourhood due to excessive amplification will not be permitted. TAC has the right to stop hirer’s that do not comply with the Noise Control Act.
Collections and Lotteries
The Hirer will not conduct any games of chance, sweepstake or lottery or take up any collection in or around the vicinity of the TAC without the prior consent of the Manager.
Smoking
Smoking is not permitted inside the Arts Centre, or within the grounds of the Arts Centre.
Refreshments and Alcohol
Under no circumstances is alcohol to be sold or consumed, in the Arts Centre or its immediate vicinity without a liquor permit and the prior consent of the TAC’s management. The Hirer will not take into the Centre a vending machine or any other structure or vehicle for the selling or offering for sale of food and beverages. TAC does not have facilities for the preparation of hot food. If the hirer engages professional caterers they must notify TAC in writing of their intention to do so at least one month prior to the date of the hire.
Domestic Animals
No domestic animals (except for Guide Dogs) may be brought into the Arts Centre.
